Pursuant to said Indiana law, I.C. 8-1.5-5-1, et seq., a department of stormwater management (department) shall be and is created for the purpose of providing for the collection, disposal and drainage of stormwater and surface water and the relieving of sanitary sewers of such water in a special taxing district which is also expressly created pursuant to that chapter of Indiana law. The department shall be a newly created branch of the civil town’s government and shall be controlled by a board of directors (board). (Ord. 826 § 2, 1993).
