5.04.020 License fee.

Applicants for a license shall pay a fee according to the following schedule:
(1) Peddlers, hawkers and street vendors shall pay a license fee of two hundred dollars per license. Each license shall be valid from the first day of the month in which the event is held or twenty days prior to the event, whichever is longer, (fifty-five days before Christmas) and end three days after the event; provided that, no such license fee but a badge cost recovery fee shall be required of disabled veterans of the military service of the United States who are residents of the state of Indiana and who pay a ten dollar per badge cost recovery fee and can provide both proof of residency in the state of Indiana and
proof of receiving a current military disability pension from the United States.
(2) Applicants intending on a temporary basis to sell or give away goods, other than food and/or ice, from any temporary or permanent structure capable of being freestanding shall pay a license fee of two hundred fifty dollars per license for each structure, even if one or more structures are linked together in some fashion. Each license shall be valid from the first day of the month in which the event is held or twenty days prior to the event, whichever is longer (fifty-five days before Christmas) and end three days after the event, except that a lesser license fee of one hundred dollars per license shall be required of disabled veterans of the military service of the United States who are residents of the state of Indiana and who can provide proof of residence in the state of Indiana and proof of receiving a current military disability pension from the United States.
(3) Applicants intending on a temporary basis to sell or give away food and/or ice from a temporary or permanent structure capable of being freestanding, shall purchase a license for the sale of food and a separate license for the sale of ice. A separate license fee for the sale of food is one hundred dollars per license, and a separate license fee for the sale of ice is twenty-five dollars per license per machine.
Any applicant who is required to purchase a license pursuant to subsection (2) of this section and also intends on a temporary basis to sell or give away food and/or ice, shall purchase a separate license for the sale of goods, a separate license for the sale of food, and a separate license for the sale of ice. This section applies even if goods, food and/or ice are sold in appurtenant structures or if goods, food and/or ice are sold from the same structure.
(4) Any applicant whose activities are not covered by the provisions of subsections (1) through (3) of this section shall pay a license fee of two hundred dollars per license.
(5) Any applicant covered by subsections (1) through (4) of this section shall be required to purchase license(s) for persons engaged in the activities described in subsections (1) through (4) as follows:

(6) All persons operating under a license or exemption must be at least eighteen years of age and carry proof thereof on their person. The only exception is that juveniles who are twelve years of age but less than eighteen years of age (and not more than twenty in number) may operate under a not-for-profit youth organization exemption; provided, each such juvenile wears a current badge purchased from the town and is supervised by a badge-carrying adult, not more than one for every two juveniles, operating under the same exemption, except that the adult must pay a one hundred dollar license fee if also engaged in selling and must be responsible for supervising two juveniles and remain in the immediate presence of the two juveniles being supervised.
(7) School-related organizations or not-for-profit organizations for youth, such as school musical organizations, Boy Scouts, Girl Scouts, Campfire Girls, etc., having clubs, troops, packs or the like made up of youth from the town of Speedway with meeting locations within the town of Speedway, may solicit for their own organizations without the requirement of purchasing badges; provided, the organization files for exemption and the youths each obtain and display cost-free badges and carry identification and/or affiliation with such exempt organization on their person.
