Chapter 5.32 BATHHOUSES, MASSAGE ESTABLISHMENTS AND ADULT ESTABLISHMENTS
5.32.030 Applications for licenses.
(a) The application for a license to operate a bathhouse, massage parlor,
massage school, massage therapy clinic, massage therapy school, adult bookstore,
adult museum, or adult theater shall be made on forms prescribed by the
clerk-treasurer, which shall contain the following information and should be
individually signed by the applicant:
(1) Name of
applicant;
(2) Resident address of the applicant and former addresses for
the past three years;
(3) Business address of applicant;
(4) If the
applicant is a corporation, a certificate from the Secretary of State of Indiana
certifying that the applicant is a corporation in good standing under the laws
of the state and is certified to do business in the state;
(5) Number of
massage tables, showers, stalls or other such individual units if
applicable;
(6) The age, date of birth and citizenship of the applicant, in
the case of individuals, and of the manager and officers in the case of a
corporation;
(7) The names, addresses, ages, citizenship and designations of
each person connected with the applicant’s establishment;
(8) The
location and inclusive dates where the applicant or its managers or officers
have ever previously engaged in operating a bathhouse, massage parlor, massage
school, massage therapy clinic, massage therapy school, adult bookstore, adult
museum or adult theater and whether a license to operate such establishment was
revoked;
(9) Whether the applicant, or in the case of a corporation, its
managers, officers, directors or stockholders have ever been convicted of any
act of violence, moral turpitude, sex offense or prior violation of this
chapter, and, if so, the time and place of such conviction and the penalty
imposed;
(10) Whether the applicant, or in the case of a corporation, its
managers, officers, directors or shareholders, have ever been convicted of a
felony in connection with the operation of a bathhouse, massage parlor, massage
school, massage therapy clinic, massage therapy school, adult bookstore, adult
museum or adult theater and, if so, the time and place of such conviction and
the penalty imposed;
(11) An agreement by the applicant and operator
permitting inspection of the establishment;
(12) Type of license being
applied for by the applicant.
(b) Along with the operator’s
application for a license there shall be filed with the clerk-treasurer a
verified application for a massage therapist license by each individual who is
employed in a bathhouse, massage parlor, massage school, massage therapy clinic,
or massage therapy school. The application shall be made on forms prescribed by
the clerk-treasurer which shall request the following information:
(1) Name
of applicant;
(2) Resident address of applicant and former addresses for the
past three years;
(3) Age and date of birth of
applicant;
(4) Citizenship of applicant;
(5) Whether the applicant has
ever been convicted of any public offense concerning an act of violence, moral
turpitude, sex offense or prior violation of this chapter and, if so, the time
and place of such conviction and the penalty imposed;
(6) Nature of work
performed by applicant.
(c) Along with the application filed pursuant to
subsection (b) of this section, the applicant shall file a certificate from a
duly licensed medical practitioner on a form prescribed by the health and
hospital corporation of the county, certifying that the applicant is free from
communicable diseases and that the examination has been made within thirty days
prior to the application for the license herein sought. (Ord. 590 § 3,
