The provisions of Section 9.40.030 shall not apply if:
(1) The boat is parked within a garage or other type of structure so as to be completely enclosed from view; provided that the garage or structure is built in conformity with the building code of the town then in effect; or
(2) The boat:
(A) Does not exceed twenty-seven feet in length and the combined height of boat and trailer is five feet or more, and
(B) Is parked to the rear of the front line of any residential structure located on the lot or parcel of real estate upon which the boat is parked, and
(C) Does not encroach upon either the front, side or rear setback line of the lot or parcel of real estate upon which it is parked;
(3) The boat:
(A) Does not exceed sixteen feet in length and the combined height of boat and trailer is less than five feet, and
(B) Is parked to the rear of the front line of any residential structure located on the lot or parcel of real estate upon which it is parked, and
(C) Does not encroach upon either the front or rear setback line of the lot or parcel of real estate upon which it is parked. (Ord. 446 § 1(part), 1970).
