12.03.040 Types of permits.

(a) Utility permit. This permit allows cable operators and utilities to use the public right-of-way for initial location and installation of cable/utility lines within the boundaries of the town of Speedway.
(b) Excavation permit. This permit is required whenever excavation is being made in the paved areas of the public right-of-way. This permit includes the use of the lane in which excavation is located. To the fullest extent reasonably possible without impeding the restoration of needed utility services or when a clear and present danger to public safety is demonstrated, the town may restrict excavation in streets that have been constructed or resurfaced within two years prior to the permit application date.
(c) Non-paved area permit. This permit is required whenever excavation is being made in the non-paved areas of the public right-of-way. The permit includes the use of the lane adjacent to the excavation.
(d) Trenchless or boring permit. This permit is required whenever trenchless or boring operations are used and all incidental excavation is in the non-paved areas. The permit includes the use of the lane adjacent to the excavation.
(e) Emergency permits. This permit is authorized when situations arise which are described in Section 12.03.080.
(f) Right-of-way use permit. This permit is required whenever there are activities performed in the public right-of-way which are not described above.
All permits will be issued by the town’s clerk-treasurer on forms approved by the town council. All permit fees, except for utility permit fees, shall be waived where a fee is charged by the city of Indianapolis for the same use along the thoroughfare right-of-way. (Ord. 949 § 1(part), 2001).
