12.03.050 Application.

The application for any rights-of-way access permit shall be submitted to and approved by the town on forms approved by the town council and, at a minimum, include the following:
(1) The name, address, and telephone number of the applicant;
(2) A description of the telecommunications and/or public utility services that are or will be provided including an estimate of the cost of the project;
(3) Preliminary engineering plans, specifications and a network map of the facilities that are or will be located in the public rights-of-way;
(A) The location and route requested for the applicant’s proposed telecommunications and/or public utility facilities,
(B) The location of all underground and overhead telecommunications and/or public utility facilities that belong to the applicant in the public rights-of-way along the proposed route,
(C) The location of obstructions, including trees and other structures, if any, that the applicant will temporarily or permanently remove or relocate, and
(D) A complete restoration plan, including a schedule for completion of the restoration work.
(4) If the applicant is proposing to install overhead facilities, the applicant must provide evidence that surplus space is available for locating its telecommunications and/or public utility facilities on existing
utility poles along the proposed route. In the case of underground installation within existing ducts or conduits within the public rights-of-way, the applicant must provide information in sufficient detail to identify:
(A) Excess capacity currently available within such ducts or conduit, and
(B) Excess capacity, if any, in such ducts or conduit after installation of applicant’s telecommunications and/or public utility facilities.
(5) In the case of installation of telecommunications and/or public utility facilities to be constructed within the public rights-of-way, the applicant must provide:
(A) The proposed location for the telecommunications and/or public utility facilities, and
(B) The excess capacity that will exist after installation of the applicant’s telecommunications and/or public utility facilities.
(6) A preliminary construction schedule that includes a list of contractors and sub-contractors to be used and completion date;
(7) A proposal for traffic control, to be used during construction, that complies with the Indiana manual on Uniform Traffic Control Devices for Streets and Highways;
(8) A description of the applicant’s technical qualifications and experience regarding installation and operation of telecommunications and/or public utility facilities described in the application;
(9) Copies of all other governmental permits, or applications for permits, required to construct and operate the telecommunications and/or public utility facilities and to provide the services described in the application.
(10) All permit fees, deposits, compensation, and charges required by the ordinance codified in this chapter;
(11) Such other information as may be required by the town;
(12) Proof that an applicant is a member of the Indiana Underground Plant Protection Service (IUPPS). (Ord. 949 § 1(part), 2001).
