Chapter 12.03 PUBLIC RIGHTS-OF-WAY
12.03.130 Indemnification.
A permittee shall indemnify and hold harmless the town, its officers,
boards, commissions, agents, and employees from any and all lawsuits, claims,
causes of action, judgments and liens arising out of any act or omission by the
permittee or any of its officers, agents, or employees in connection with a
rights-of-way access permit and construction, operation, or removal of
telecommunications and/or public utility facilities. Such indemnity shall
include reasonable attorney’s fees, court costs and any other expenses
arising therefrom or incurred in connection therewith and shall not be limited
by reason of the enumeration of any insurance coverage required herein. (Ord.
