If real estate does not have access to a public sewer, the owner of the real estate may, with the prior approval of the board of trustees, repair a defective septic tank or install a new septic tank; provided, that all such repairs and installations shall be performed in conformity with the rules and regulations of the Indiana Board of Health and of the health and hospital corporation of Marion County.
