Chapter 13.32 INDUSTRIAL WASTES
13.32.050 Computing payment.
(a) Computation. The surcharge shall apply for each day that the
industrial user’s discharge exceeds the surcharge limit for B.O.D., total
oil and grease and suspended solids. When sampling events are not conducted on a
daily basis, the surcharge shall apply to each day following a sampling event in
which the industrial user’s discharge exceeds the surcharge limit, and
shall continue to apply until the next sampling event.
(b) Payment. Each
industrial user subject to the strength surcharge shall remit to the town, with
its regular sewer service bill, its surcharge as determined by its immediately
preceding certified statement.
Should inspection by the town reveal that any
certified statement filed by an industrial user does not accurately represent
actual conditions, the town shall redetermine the surcharge due and bill the
user for any deficiency together with interest as herein provided. The bill
shall be paid within ten days after receipt thereof by the
user.
(c) Interest. Interest, at the rate of two percent per month or any
fraction thereof, shall be added to any overdue surcharge payments. Such
interest shall accrue and continue to accrue from the date the industrial
user’s remittance was due until all overdue surcharges and interest are
paid.
(d) Overpayment. Any overpayment made by the industrial user will be
refunded without interest on the user’s written application. (Ord. 822
