From and after September 13, 1971 all swimming pools within the town limits shall be completely surrounded and enclosed by walls, fencing or a similar type structure not less than five feet in height and of a design and construction that will control the movement and restrain the entry of children; provided, that the walls or fencing shall not, at any point, be closer than four feet from the perimeter of the swimming pool.
